
General Terms and Conditions
These General Terms and Conditions (GTC) govern the legal relationship between customers, hereinafter referred to as guests, and Clubhotel Schweiz GmbH, the operator of the Arosa Alpine Club, hereinafter referred to as the hotel. For the sake of simplicity, these GTC always refer to the term “contract” – regardless of the service. The contracting parties are the guest and the hotel. Should individual provisions of these GTC be ineffective or invalid, this shall not affect the validity of the contract and the remaining provisions of these GTC.
The place of jurisdiction for any disputes arising from this contract shall be Arosa (Canton of Graubünden), unless another legally mandatory place of jurisdiction exists. Swiss law shall apply exclusively to all contracts, reservations, and any additional agreements, as well as these general terms and conditions. The place of performance and payment is Arosa.
The contract for the rental of rooms and other rooms within the hotel, as well as outdoor areas belonging to the hotel’s property, as well as the purchase of other supplies and services, is concluded upon the guest’s written confirmation. Electronically transmitted documents such as emails and online-generated forms are also considered written confirmations.
A reservation made on the day of arrival itself, whether verbally or in writing, is binding upon acceptance by the hotel and cannot be canceled.
Changes to the contract only become binding for the hotel upon written confirmation. Unilateral changes or additions to the contract by the guest are invalid.
The subletting and further rental of the rooms provided, as well as their use for purposes other than accommodation, require the hotel’s prior written consent.
The scope of services of the contract is determined by the guest’s individually made and confirmed reservation.
The guest has no right to a specific room – unless otherwise contractually agreed.
If, despite a confirmed reservation, no rooms are available at the hotel, the hotel must inform the guest in a timely manner and offer equivalent accommodation in a nearby hotel of a comparable or higher category. Any additional expenses for the alternative accommodation are borne by the hotel. If the guest rejects the alternative room, the hotel must immediately reimburse any services already provided by the guest (e.g., deposits). The guest has no further claims.
Unless otherwise agreed, the guest is entitled to use the rented rooms from 3 p.m. on the agreed arrival date. Check-in is possible until 10 p.m. Also subject to other agreements, rented rooms and occupied parking spaces must be vacated by 11 a.m. on the departure date.
Option dates are binding for both parties. After the option period has expired without being used, the hotel may dispose of the opted-in rooms without further notice.
The prices communicated by the hotel are in Swiss francs (CHF) and include statutory value-added tax.
Any increase in statutory taxes after the contract has been concluded shall be borne by the guest.
Prices quoted in foreign currencies are guidelines and will be charged at the current daily exchange rate. The prices confirmed by the hotel are valid.
The hotel may change prices if the guest subsequently requests changes to the number of rooms booked, the hotel’s services, or the length of stay.
The hotel may request a deposit of the booking amount or advance payment of the entire booking amount. If the deposit or advance payment is not made on time, the hotel may withdraw from the contract (including all promised services) immediately (without notice) and demand cancellation fees.
The final invoice includes the agreed price plus any additional amounts incurred due to additional services provided by the hotel for the guest and/or accompanying persons. Unless otherwise agreed, the final invoice is to be paid in Swiss francs at the latest upon check-out on the day of departure, in cash or by accepted debit or credit card.
Cancellation of a reservation by the guest before the date stated in the booking confirmation is free of charge. In the event of later cancellations, the agreed price for the entire stay will be charged. In the event of late arrival, early departure, or no-show, the hotel is entitled to charge 100% of the total booked services.
Travel cancellation insurance is recommended.
The hotel endeavors to reimburse unused services in the event of cancellations, late arrival, or early departure.
